Musizieren darf der Wohnraummieter, Musikunterricht geben ohne vorherige Erlaubnis des Vermieters jedoch grunds\u00e4tzlich nicht.<\/p>\n

Musikh\u00f6ren und Musizieren geh\u00f6ren als sozial \u00fcbliches Verhalten zum herk\u00f6mmlichen Mietgebrauch. Au\u00dferhalb der Ruhezeiten kann die Harfe gezupft, der Geigenbogen geschwungen und in die Pianotasten gehauen werden. Musizieren ist grundrechtlich gesch\u00fctzt (freie Entfaltung der Pers\u00f6nlichkeit). Aber auch beim Musizieren in den heimischen vier W\u00e4nden spielt die R\u00fccksicht eine gro\u00dfe Rolle. Die Gerichte nehmen au\u00dferhalb der Ruhezeiten eine 2 bis 3 st\u00fcndige \u00dcbungszeit als zul\u00e4ssig an. Die konkrete Wohnsituation ist im Endeffekt jedoch wohl entscheidend. Auch darf der Berufsmusiker wohl mehr \u00fcben, als der mietende Klempner. Problematischer als die private Tonerzeugung kann sich das gewerbliche Musizieren darstellen.<\/p>\n

J\u00fcngst entschied der BGH den folgenden Fall (BGH Urteil vom 10. April 2013 \u2013 VIII ZR 213\/12<\/a>). \u00dcber mehrere Jahre hinweg gab ein in Berlin lebender Mieter ohne Erlaubnis des Vermieters in der Wohnung Gitarrenunterricht. Er hatte an je drei Werktagen ungef\u00e4hr zehn bis zw\u00f6lf Sch\u00fclern w\u00f6chentlich das gekonnte Gitarrenspiel zu vermitteln versucht. Die Wohnung wurde dem h\u00f6chsten deutschen Zivilgericht zufolge entgegen dem vertraglichen Nutzungszweck (Nutzung zu Wohnzwecken) demnach auch gewerblich genutzt. Auf Grund der durch den Musikunterricht verursachten Emissionen kam es zu Streitigkeiten mit anderen Mietern und einer den Hausfrieden unzumutbar beeintr\u00e4chtigenden Situation und letztendlich zu einer K\u00fcndigung.<\/p>\n

Der Bundesgerichtshof erkl\u00e4rt in seiner Entscheidung in aller Deutlichkeit, dass \u201eunter den nach der Verkehrsanschauung zu bestimmenden Begriff des „Wohnens“ nur solche berufliche T\u00e4tigkeiten des Mieters fallen, die in einer nicht nach au\u00dfen in Erscheinung tretenden Weise ausge\u00fcbt werden\u201c.<\/p>\n

Ferner erl\u00e4utert der BGH, dass der Vermieter nicht ohne vorherige Vereinbarung die gesch\u00e4ftlichen Aktivit\u00e4ten des Mieters, die der Mieter in ausschlie\u00dflich zu Wohnzwecken vermieteten R\u00e4umen aus\u00fcbt und die nach au\u00dfen in Erscheinung treten, dulden muss.<\/p>\n

Die Karlsruher Richter f\u00fchren weiter aus, dass eine Verpflichtung des Vermieters, eine vertragswidrige Nutzung der Mietr\u00e4ume zu gestatten, nur dann in Betracht kommen mag, wenn von der beabsichtigten T\u00e4tigkeit, hier also dem Musikunterricht, keine weitergehenden Einwirkungen auf die Mietsache oder Mitmieter ausgehen als bei einer \u00fcblichen Wohnnutzung.<\/p>\n

Der Mieter hat im \u00dcbrigen darzulegen und zu beweisen, dass sein gewerbliches Musizieren keine st\u00e4rkeren Beeintr\u00e4chtigungen nach sich zieht, als private Musik\u00fcbungen.<\/p>\n

Wegen des sogenannten Publikumsverkehrs (Musiksch\u00fcler kommen und gehen) entfaltet der Musikunterricht eine entsprechende Au\u00dfenwirkung. Allein diese Au\u00dfenwirkung ist Grund f\u00fcr das Erfordernis einer vermieterseitigen Erlaubnis, auch bei freiberuflich musizierenden Lehrern. Denn der Vermieter von Wohnraum hat gesch\u00e4ftliche Umtriebe des Mieters, die nach au\u00dfen in Erscheinung treten, grunds\u00e4tzlich nicht ohne entsprechende vorherige Vereinbarung dulden (BGH Urteil vom 14. Juli 2009 – VIII ZR 165\/08<\/a>).<\/p>\n

Im hiesigen Fall konnte dem Vermieter auch kein Versto\u00df gegen das Gebot von Treu und Glauben unterstellt werden, da ein Anspruch auf Erlaubniserteilung gerade nur bei einer freiberuflichen Nutzung ohne nennenswerte Au\u00dfenwirkung und im Ma\u00dfe einer \u00fcblichen Wohnungsnutzung zust\u00fcnde. Die K\u00fcndigung des Vermieters hatte somit Bestand.<\/p>\n
