Dies liegt nicht zuletzt an der Erh\u00f6hungsm\u00f6glichkeit der Miete nach <a href=\"https:\/\/dejure.org\/gesetze\/BGB\/559.html\" title=\"&sect; 559 BGB: Mieterh&ouml;hung nach Modernisierungsma&szlig;nahmen\">\u00a7 559 BGB<\/a> \u2013 bis zu 11% der Modernisierungskosten j\u00e4hrlich und unabh\u00e4ngig von einer vorherigen Mieterh\u00f6hung.<\/p>\n<p class=\"MsoNormal\">Am 1. Mai 2013 ist das neue Mietrecht in Kraft getreten und mit ihm auch Neuregelungen im Hinblick auf die Modernisierungsvorschriften.<\/p>\n<p class=\"MsoNormal\">Die vormals in <a href=\"https:\/\/dejure.org\/gesetze\/0BGB010102\/554.html\" title=\"&sect; 554 BGB a.F.: Duldung von Erhaltungs- und Modernisierungsma&szlig;nahmen\">\u00a7 554<\/a> a.F. BGB gewachsenen Ansichten der Rechtsprechung und die fr\u00fcher geltenden Regeln zur Duldung von Modernisierungsma\u00dfnahmen sind durch die neu eingef\u00fcgten Vorschriften der <a href=\"https:\/\/dejure.org\/gesetze\/BGB\/555a.html\" title=\"&sect; 555a BGB: Erhaltungsma&szlig;nahmen\">\u00a7\u00a7 555a -555f BGB<\/a> in Inhalt und Systematik ge\u00e4ndert worden.<\/p>\n<p class=\"MsoNormal\">Nunmehr ist es f\u00fcr Mieter deutlich schwieriger tragkr\u00e4ftige Argumente gegen die Duldungspflicht vorzubringen. Schon nach der alten Regelung bestand eine generelle Duldungspflicht des Mieters, sofern die baulichen Ma\u00dfnahmen des Vermieters zu einer Verbesserung der Mietsache (bessere Benutzung oder Erh\u00f6hung des Gebrauchswertes) f\u00fchrten und keine Luxusmodernisierung darstellten. Jedoch konnte noch im April 2013 ein Mieter der Duldungsverpflichtung mit dem Argument der finanziellen H\u00e4rte begegnen. Dieser Umstand hat sich durch die Mietrechtsreform gewandelt.<\/p>\n<p class=\"MsoNormal\">Den Gesetzesmaterialien und <span>\u00a0<\/span>den Angaben des Bundesministeriums der Justiz ist zu entnehmen, dass es ein besonderes Anliegen der zum Gesetz f\u00fchrenden Mehrheiten im Bundestag war, zuk\u00fcnftig dem Vermieter mehr Planungssicherheit in der Bauphase zuzugestehen. <span>\u00a0<\/span>Ein \u201eHinausmodernisieren\u201c sei <span>\u00a0<\/span>jedoch nicht zu bef\u00fcrchten, da der Mieter seine schlechte finanzielle Konstitution im Mieterh\u00f6hungsverfahren zur Geltung bringen k\u00f6nne und damit seiner Kostentragungspflicht am Modernisierungsaufwand weiterhin entgehen k\u00f6nne. Auf die Haken und \u00d6sen der Nichteinhaltung von Fristen sei in diesem Zusammenhang (vgl. <a href=\"https:\/\/dejure.org\/gesetze\/BGB\/555d.html\" title=\"&sect; 555d BGB: Duldung von Modernisierungsma&szlig;nahmen, Ausschlussfrist\">\u00a7 555d Abs.3 BGB<\/a>)aufmerksam gemacht.<\/p>\n<p class=\"MsoNormal\">Es wird in Zukunft also voraussichtlich eine Verlagerung der gerichtlich auszutragenden Konflikte hinsichtlich der Modernisierungsma\u00dfnahmen, weg von der Duldungsebene, hin in die Mieterh\u00f6hungsebene nach <a href=\"https:\/\/dejure.org\/gesetze\/BGB\/559.html\" title=\"&sect; 559 BGB: Mieterh&ouml;hung nach Modernisierungsma&szlig;nahmen\">\u00a7 559 BGB<\/a> erfolgen. Eine Duldung von modernisierenden Bauma\u00dfnahmen ist nach neuem Recht wohl nur in seltenen F\u00e4llen nicht f\u00fcr den Vermieter durchsetzbar. Der nunmehr in <a href=\"https:\/\/dejure.org\/gesetze\/BGB\/555d.html\" title=\"&sect; 555d BGB: Duldung von Modernisierungsma&szlig;nahmen, Ausschlussfrist\">\u00a7 555d Abs.2 BGB<\/a> genannte H\u00e4rteeinwand des Mieters bezieht sich bei verst\u00e4ndiger Lesart nicht mehr auf finanzielle H\u00e4rten, sondern auf Einwirkungen auf den Mieter oder die Mietsache (bspw. pers\u00f6nliche Lebensumst\u00e4nde wie Krankheit oder bevorstehende Pr\u00fcfung und somit nicht zu ertragende Bauarbeiten oder Wegfall von Wohnraum durch die Bauma\u00dfnahme). Besteht ein beachtlicher H\u00e4rtegrund, ist dieser dann mit den Vermieterinteressen abzuw\u00e4gen.<\/p>\n<p class=\"MsoNormal\">Es stellt sich die Frage, wie mit Modernisierungen zu verfahren ist, beziehungsweise welches Recht gilt, wenn vor dem 1. Mai 2013 eine Ank\u00fcndigung von Modernisierungsma\u00dfnahmen erfolgt ist, die Modernisierung jedoch erst nach diesem Datum ihre Realisierung finden soll.<\/p>\n<p class=\"MsoNormal\">\u00a0<\/p>\n<p class=\"MsoNormal\">Der Gesetzgeber hat f\u00fcr diesen Fall eine \u00dcbergangsregelung konzipiert. Diese ist in <a href=\"https:\/\/dejure.org\/gesetze\/EGBGB\/229.html\" title=\"Art. 229 EGBGB: Weitere &Uuml;berleitungsvorschriften\">Artikel 229<\/a> Einf\u00fchrungsgesetz zum BGB in \u00a7 29 (\u00dcbergangsvorschriften zum Mietrechts\u00e4nderungsgesetz)enthalten und lautet:<\/p>\n<p class=\"MsoNormal\"><i><\/i><em>(1) Auf ein bis zum 1. Mai 2013 entstandenes Mietverh\u00e4ltnis sind die \u00a7\u00a7 536, 554, 559 bis 559b, 578 des B\u00fcrgerlichen\u00a0\u00a0\u00a0\u00a0\u00a0 Gesetzbuchs in der bis zum 1. Mai 2013 geltenden Fassung weiter anzuwenden, wenn<\/em><\/p>\n<p class=\"MsoNormal\"><em>1. bei Modernisierungsma\u00dfnahmen die Mitteilung nach <a href=\"https:\/\/dejure.org\/gesetze\/BGB\/554.html\" title=\"&sect; 554 BGB: Barrierereduzierung, E-Mobilit&auml;t, Einbruchsschutz und Steckersolarger&auml;te\">\u00a7 554 Absatz 3 Satz 1<\/a> des B\u00fcrgerlichen Gesetzbuchs dem Mieter vor dem 1. Mai 2013 zugegangen ist oder<\/em><\/p>\n<p class=\"MsoNormal\"><em>2. bei Modernisierungsma\u00dfnahmen, auf die <a href=\"https:\/\/dejure.org\/gesetze\/BGB\/554.html\" title=\"&sect; 554 BGB: Barrierereduzierung, E-Mobilit&auml;t, Einbruchsschutz und Steckersolarger&auml;te\">\u00a7 554 Absatz 3 Satz 3<\/a> des B\u00fcrgerlichen Gesetzbuchs in der bis zum 1. Mai 2013 geltenden Fassung anzuwenden ist, der Vermieter mit der Ausf\u00fchrung der Ma\u00dfnahme vor dem 1. Mai 2013 begonnen hat.<\/em><\/p>\n<p class=\"MsoNormal\"><em>(2) <a href=\"https:\/\/dejure.org\/gesetze\/BGB\/569.html\" title=\"&sect; 569 BGB: Au&szlig;erordentliche fristlose K&uuml;ndigung aus wichtigem Grund\">\u00a7 569 Absatz 2a<\/a> des B\u00fcrgerlichen Gesetzbuchs ist auf ein vor dem 1. Mai 2013 entstandenes Mietverh\u00e4ltnis nicht anzuwenden.<\/em><\/p>\n<p class=\"MsoNormal\">\u00a0<\/p>\n<p class=\"MsoNormal\">Demzufolge ist altes Recht (also <a href=\"https:\/\/dejure.org\/gesetze\/0BGB010102\/554.html\" title=\"&sect; 554 BGB a.F.: Duldung von Erhaltungs- und Modernisierungsma&szlig;nahmen\">\u00a7 554<\/a> a.F.
