Eine Farbkombination kann als Marke kraft Verkehrsgeltung geschützt sein, wenn die Anordnung und das flächenmäßige Verhältnis eindeutig bestimmt sind – UHU<\/p>\n

In dieser Entscheidung hat sich der BGH mit der Frage befasst, unter welchen Voraussetzungen eine Farbkombination markenrechtlichen Schutz als Marke kraft Verkehrsgeltung beanspruchen kann.<\/p>\n

<\/p>\n

\nLeitsätze des BGH:<\/p>\n

a) Hat der Kläger sein Klagebegehren auf Ansprüche aus einem Markenrecht und aus ergänzendem wettbewerbsrechtlichem Leistungsschutz gestützt, kann das Berufungsgericht die Revision beschränkt auf die markenrechtlichen oder die wettbewerbsrechtlichen Ansprüche zulassen.<\/p>\n

b) Eine Marke kraft Verkehrsgeltung nach § 4 Nr. 2 MarkenG<\/a> braucht nicht graphisch darstellbar i.S. von § 8 Abs. 1 MarkenG<\/a> zu sein.<\/p>\n

c) Für die Marke kraft Verkehrsgeltung gilt das Gebot der Bestimmtheit. Bei einer als Marke kraft Verkehrsgeltung beanspruchten Farbkombination müssen die systematische Anordnung und das flächenmäßige Verhältnis der Farben klar und eindeutig bestimmt sein.<\/p>\n
