Bisher gab es keine h\u00f6chstrichterliche\nRechtsprechung zu diesem Thema, doch das wird sich bald \u00e4ndern. Die m\u00fcndliche\nVerhandlung hat bereits am 05. Mai 2020 stattgefunden.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Wie haben die Gerichte bisher\nzum Abgasskandal entschieden?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Wir haben bereits Ende letzten Jahres eine Auflistung von oberlandesgerichtlichen Entscheidungen zum Dieselskandal ver\u00f6ffentlicht. <a href=\"https:\/\/www.legalsmart.de\/blog\/oberlandesgerichte-zum-abgasskandal\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (\u00f6ffnet in neuem Tab)\">Diese finden Sie hier. <\/a>Darin zeichnete sich bereits ab, dass die Chancen f\u00fcr ein erfolgreiches Vorgehen gegen VW und Co im Abgasskandal sehr gut stehen. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Au\u00dferdem berichteten <a href=\"https:\/\/www.legalsmart.de\/blog\/achtung-was-der-bgh-zum-abgasskandal-sagt\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (\u00f6ffnet in neuem Tab)\">wir hier<\/a> bereits \u00fcber den Hinweisbeschluss des BGH zum Abgasskandal. Darin ging es um die Fragen, ob ein Fahrzeug mangelhaft ist, weil eine Abschaltvorrichtung verbaut ist und ob die Fahrzeughersteller ein Nachfolgemodell ausliefern m\u00fcssen, wenn das gekaufte Fahrzeug nicht mehr von ihnen produziert wird. Der BGH beantwortete beide Fragen mit einem klaren \u201eJa!\u201c.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Worum geht es im aktuellen\nVerfahren zum Abgasskandal vor dem BGH?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In dem Fall, \u00fcber den der BGH\nzeitnah entscheiden wird, geht es um einen Kl\u00e4ger, der bereits im Jahr 2014 einen\ngebrauchten VW Sharan bei einem H\u00e4ndler kaufte. Es stellte sich dann im Rahmen\ndes Dieselskandals heraus, dass das Auto mit einer Abschaltvorrichtung versehen\nist. Der Kl\u00e4ger verlangt nun von VW die Zahlung des Kaufpreises in H\u00f6he von 31.490\nEuro bei R\u00fcckgabe des Fahrzeugs. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Das LG Bad Kreuznach war zun\u00e4chst\nmit dem Fall besch\u00e4ftigt und wies die Klage auf Schadensersatz gem. <a href=\"https:\/\/dejure.org\/gesetze\/BGB\/826.html\" title=\"&sect; 826 BGB: Sittenwidrige vors&auml;tzliche Sch&auml;digung\">\u00a7 826 BGB<\/a> ab.\nDie Berufung des Kl\u00e4gers vor dem OLG Koblenz war teilweise erfolgreich. Es\nsprach dem entt\u00e4uschten Autok\u00e4ufer 25.616,10 Euro nebst Zinsen zu. Den Rest zog\nes ab, weil der K\u00e4ufer das Fahrzeug genutzt habe. Dagegen legten sowohl der\nKl\u00e4ger als auch VW Revision ein, sodass nun der BGH entscheiden muss.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Wie wird der BGH zum\nAbgasskandal entscheiden?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Dieser Fall ist der erste, den der BGH entscheiden wird, und es werden noch weitere Entscheidungen folgen. Wie die Verfahren ausgehen werden, ist noch nicht entschieden. Jedenfalls aber in diesem aktuellen Fall gibt es aber schon eine Tendenz. In der m\u00fcndlichen Verhandlung vom 5. Mai 2020 soll sich der BGH auf die Seite des Kunden geschlagen haben und erkl\u00e4rt, dass ein Schaden entstanden sei, den VW ersetzen m\u00fcsse \u2013 abz\u00fcglich einer Nutzungspauschale. Es kann also gut sein, dass der BGH das Urteil des OLG Koblenz best\u00e4tigt. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Was bedeutet die Entscheidung des BGH beim Abgasskandal?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Wenn der BH tats\u00e4chlich so\nentscheidet, wie vermutet, dann stehen die Chancen f\u00fcr alle weiteren Verfahren\nsehr gut, dass die K\u00e4ufer den Kaufpreis f\u00fcr ihren Schummeldiesel wiederkriegen,\nda sich die Instanzgerichte an der Rechtsprechung des BGH orientieren. Einen\nWehrmutstropfen stellt allerdings die Nutzungsentsch\u00e4digung dar, die der BGH\nden Autoherstellern anscheinend zusprechen will. Die K\u00e4ufer m\u00fcsse also damit\nrechnen, dass ein paar tausend Euro daf\u00fcr abgezogen werden, dass sie jahrelang mit\nden Autos gefahren sind. Immerhin gibt es aber noch einen Zinsanspruch, der im\nLaufe der Jahre auch einen betr\u00e4chtlichen Betrag ausmacht.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Was sollten Kunden im Abgasskandal tun?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Wer einen Diesel mit\nAbschaltvorrichtung gekauft hat, sollte die \u00c4u\u00dferungen des BGH zum Anlass\nnehmen, doch noch gegen VW vorzugehen bzw. laufende Verfahren weiter durchzuziehen\nund nicht auf einen Vergleich mit VW und Co einzugehen.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Wir helfen Ihnen!<\/strong> <\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Sie haben Fragen zum Abgasskandal?
